PREFACE

 

It is notified for general information that the Corporation, in pursuance of the power conferred by section 45 (1) of the Ports Act 1997 do hereby publish this Tariff Book of Port Dues and Charges on Marine, Shipping, Stevedoring, Handling, Containers and other services.

Most of this Tariff Book has been denominated in United States Dollars (USD). All Port users who in the previous tariff paid in Tanzania Shillings shall continue to pay in Tanzania Shillings but at the exchange rate ruling on the date of transaction.

PRELIMINARY INTERPRETATION

 

A.          SHORT TITLE AND COMMENCEMENT

1.  This Tariff Book shall be cited as the Zanzibar Ports Corporation Tariff Book and the rates set out hereunder shall be applicable to maritime ports in Zanzibar (Unguja and Pemba).

B.          APPLICATION

2.  This Tariff Book shall apply to all sea ports and harbours set out in the Zanzibar Ports Corporation Act 1997.

C.          INTERPRETATION

In this Tariff Book, the following capitalized words shall have the meaning assigned to them below:

“ACT” means the Zanzibar Ports Corporation Act, 1997

CHARGES” means all sums received or receivable, charged or chargeable for or in respect of the warehousing of goods by the Corporation or for in respect of any ship or harbour or any other service performed or facility provided by the Corporation.

Wherever in this tariff book services shown both in Tonnage and CBM, charges will on whichever the greater of the other.

“G.R.T”   means Gross Registered Tonnage

“TONNE”means a unit measurement of weight or volume equivalent to 1,000 kilogrammes or 1 Cubic Metre.                

“PER TONNE orPER HARBOUR TONNE” in          relation to this Tariff Book shall mean a Unit of charge

equivalent of 1 dead – weight tonne or 1 Cubic Metre

whichever yields the higher charge or in relation to fresh water supplied to ship shall mean  a unit or charge         equivalent to 224 gallons or 1,000 litres.

“USD” means the currency of the United States of        America.

“ZPC” means Zanzibar Ports Corporation established by         ZPC act, 1997.

Power of Management to impose Surcharges and Adjust charges

Management may impose specific or general surcharges or adjust upwards the rates set out in this Tariff Book according to the nature of the services rendered or facility provided or afforded or on account of specific or general economic consideration.

D.         REGULAR WORKING HOURS AND OVERTIME

Regular Working Hours shall mean the appointed hours of business as may, from time to time, be prescribed by Management for the provision of any particular service or facility.

Overtime shall mean hours worked outside regular working hours and, in addition, in the case of stevedoring gangs, extensions of regular working hours specified for a particular shift, shall constitute “overtime”.

When a party desires any services as enumerated under item Dto be performed during   hours other than the regular working hours or when a party requests for an extension of the regular working hours specified for a particular shift in respect of shore handling and stevedoring gangs, a requisition for the working of overtime must, on each occasion, be made to Management in the form and within the period of notice as may be prescribed by the Management. Services so provided outside regular working hours shall be charged for as overtime in accordance with the provision of this Tariff Book.                   

E.          SERVICE NOT OTHERWISE ENUMERATED

Any other service not enumerated anywhere else in this Tariff will be rendered on application and will be subject to such charges as the Corporation may determine from time to time.

F.          VALUE ADDED TAX (VAT)

All charges in this Tariff exclude VAT and any other statutory charges where applicable. VAT and those other statutory charges / levies will be applied at the rate(s) applicable at the time of billing or payment.

 

   CLAUSE 1: PILOTAGE FEES

Where the services of a pilot have been requested to bring a vessel in Port and the Pilot proceeds in response to that request but the ship does not pick up the pilot, a fee twice as much the one payable under 1(a) above shall be levied.

          3.  Exemption from compulsory pilotage

The following vessels are exempted from compulsory pilotage:-

(a)     Vessels owned or operated by the Government other than those engaged in commercial trade.

(b)     Vessels owned or operated by the Corporation

(c)      Ferry boat plying as such exclusively within the limits of the ports and whose GRT is not more than 200 tonnes.

(d)     Vessels of less than 200 tonnes not registered and all other vessels of less than 200 GRT in case of local vessels.

(e)      Tugs, Dredgers, Barges or similar vessels whose ordinary course of navigation does not extend beyond the limits of the ports.

(f)       Vessels by notice in the official gazette exempted by the Minister for Infrastructure and Communication.

(g)      Vessels exempted by the Director General in any one particular case.

·        Provided that such exemption will not endanger the assured safety of Ports Installations, other vessels and other marine crafts.

4.  Charge for the Certificate of Exemption from compulsory Pilotage

Whenever the ship is exempted by the Management from the compulsory pilotage, the master of that particular ship will be required to obtain the certificate of exemption from the compulsory pilotage.  Unless suspended, change of the master or withdrawal by the Management, or whichever is the soonest, this certificate will be valid for the period not exceeding twelve months.

The fees for the certificate shall be 30.00 USD regardless the          vessel’s tonnage. Provided that such exemption will not endanger the assured safety of ports, the Management will not be responsible for any fault or accident that will be caused by the vessel having a master on board who has been exempted on this certificate.

CLAUSE 2: PORT DUES

Port Dues shall be paid by all vessels entering Port.  The charge shall be raised on gross registered tonnage (GRT) of the vessel as follows: -

4.     (a) Ships entering port on account of stress such as                               bad weather of mutinous crews or disabled or for         medical assistance shall not be charged port dues for the first 48 hours after their arrival.  (b) For any period above 48 hours stay, such vessels will pay half the normal rates specified under Items 1 and 2 above.

(c) The privilege under item 4(a) will be accorded at the sole discretion of Management.

5.   Ships calling for slipping or dry docking shall pay half the rates spesified in Items 1 and 2 above

7.          EXEMPTION FROM PORT DUES

     The following vessels are exempted from payment of Port  Dues:-  

     (a)         Warships of all friendly nations and government vessels not engaged on trading voyage.

(b)        Vessels lying in outer anchorage for the purpose of landing or embarking/disembarking passengers and mail only.  However, should such vessel load or discharge cargo, port dues at normal rates specified under Item 1 and 2 above shall become payable.

(c)         All vessels which have been registered in Zanzibar.

 CLAUSE 3: NAVIGATIONAL DUES

1.Combined navigational dues covering the use of all coast lights in Tanzania Mainland and Zanzibar shall be levied as follows:-

2. Vessels may pay in advance for a calendar year an annual fee equivalent to 10 calls in one year.  Should such vessels make more or less calls than paid for in advance, no adjustment shall be made on the advance payment.

3. Ships shall pay combined light dues at the first port of call in Tanzania Mainland or Zanzibar.

4.Ships (Other than those covered under Items 5 (i) and (iii) below) which remain in the ports of Zanzibar or Tanzania Mainland shall be charged once only per turn – around voyage.

5.   Exemption

The following vessels are exempted from Navigational Dues:

 (i) Warships of all friendly nations and government vessels not engaged in trading voyage.

(ii)Ships entering a port on account of stress of weather or with mutinous crew or ships entering disabled or for medical assistance (provided they do not stay in port longer than 48 hours)

                For any period in excess of 48 hours, such ships    

                shall pay the normal rate specified under item 1     

                No.1 above.

         This privilege will be accorded at the sole discretion  

       of Management.

(iii)      Traditional fishing boats and traditional vessels.

 

CLAUSE 4: DOCKAGE AND BUOYAGE

In this Clause,

“Steam” shall include all power used for propulsion.

“Vessel”shall include all ships, traditional vessels, small crafts, lighters and pontoons.

                 (i)     Imports

From the time the lighter or pontoon is placed alongside the ship until it is ashore, or 12 hour after it is removed from the ship whichever is earlier.

                (ii)    Exports

Lighters shall be prepared in advance of ship’s appointed time but hire time shall commence 12hours from the posted ship’s arrival time as advised by the agent and run until it is emptied. In case of Coasters, hire time shall start from the time of commencing to load the lighter or pontoon ashore until it is emptied.

(b)   Hire of Lighters and or pontoons is subject to availability.

(c)    Notwithstanding payment of hire charges, the lighters and pontoons will be operated by the Corporation’s personnel.

 

CLAUSE 7: MOORING AND UNMOORING SERVICES

Mooring and unmooring vessels is compulsory berthing alongside the Port, the charges shall be raised as follows:-

4.  ORDERING OF GANGS

Ordinary working hours should start at 0700 and 1500 hours.  If gang are required on Saturday/Sunday/ public Holiday without advance notice (Notice should be given on Friday) Gangs to be charged from 0700 hours (Whatever time work commences).

     Should stevedoring gang be ordered by the Master or Agent of the Ship for working ordinary not required charges shall be raised against the vessel to a minimum of 8 hours for each gang as per Clause No: 9 (1) (a-f).

CLAUSE 16: SLIPPING AND UNSLIPPING OF VESSELS, HIRE OF SLIPWAY

The Corporation may, at its discretion and subject to its own requirement, permit its slipway, to be hired for work to be done on vessels privately, subject to conditions of hire as laid down by the Corporation and incorporated in an Agreement to hire to be entered into between the hirer and the Corporation.

Application for the use of Port Slipway facilities, giving particulars of the vessel to be slipped, the time for which occupation of the slipway is needed, and the work proposed to be carried out on the vessel, should be made to the Director of Technical, ZPC.
